A relevant Bill, introduced by the People´s Deputy M. Kravchenko, was Registered in The Verkhovna Rada of Ukraine.

 

The Bill (Reg. No. 2023) amends the Laws ‘On the Capital of Ukraine, Hero City Kyiv´, ‘and ‘On City State Administrations´ to the effect that, ‘ the elected Kyiv City Mayor is not allowed to also fulfil the duties of the Head of the Kyiv City State Administration concurrently´.

 

The Bill purports that the Head of Kyiv City State Administration will be appointed and dismissed by The President of Ukraine, on the basis of a Representation from The President of Ukraine.

 

The Bill envisages that the Authorities of the Head of Kyiv City State Administration shall be set out in the Law, ‘On City State Administrations´ and the Law at issue . Appointment and Dismissal of the First Deputy, and Deputies of the Head of Kyiv State Administration, will be effected by the Cabinet of Minister of Ukraine.

 

Where a temporary fulfilment of duties in such positions is required, the term shall not exceed 90 days.

 

According to the Bill, ‘Heads of City State Administrations and the Head of Kyiv City State Administration shall acquire their Authorities upon appointment.

 

M.Kravchenko notes that the implementation of the current Law has led to a disbalance between the Legislative and Executive Power in Kyiv, Ukraine´s Capital. According to M.Kravchenko, ‘The Executive Authority is indeed able, under certain circumstances, to ignore decisions taken by the City Power, and operate in an autonomous mode´. He also considers that ‘appointments of the First Deputy and Deputies of the Head of Kyiv City State Administration are usually made solely by the Kyiv City Mayor or the Head of the Kyiv City State Administration, sometimes taking no account of the position of The President of Ukraine and the Cabinet of Ministers of Ukraine concerning these appointments´.
